SEXUAL HARASSMENT

The Board of Education is committed to safeguarding the right of all employees within the school district to a work environment that is free from all forms of sexual harassment. Sexual harassment is forbidden by federal and state law and by the Litchfield Board of Education and will not be tolerated in the Litchfield Public Schools. Employees and students are expected to adhere to a standard of conduct that is respectful and courteous to fellow employees and students and to the public. The Board recognizes that sexual harassment can originate from a person of either sex against a person of the opposite or same sex, and from peers as well as supervisors.

Should sexual harassment be alleged, Board policy dictates that it shall be thoroughly investigated and that the problem/concern shall be appropriately addressed. Any employee who believes that he or she has been subjected to sexual harassment should report the alleged misconduct to the Title IX Coordinator or the Superintendent of Schools as soon as possible. All complaints will be treated confidentially. No adverse employment action will be taken against an employee making a good faith report under this policy.

Training

At regular intervals employees will receive training regarding sexual harassment and related matters. Such training may include a review of this regulation and procedures, discussion, films, or other activities.

Definition

Sexual harassment is defined as "any unwelcome sexual advances, requests for sexual favors, or other verbal, visual, or physical conduct of a sexual nature," made by someone from or in the work or education setting. Sexual harassment occurs when:

  1. Submission to the conduct is explicitly or implicitly made a term or condition of an individual's employment, participation, or progress, or
  2. Submission to, or rejection of, the conduct by the individual is used as the basis of employment or educational decisions affecting the individual, or
  3. The conduct has the purpose or effect of having a negative impact upon the individual's work or academic performance, or of creating an intimidating, hostile, or offensive work or educational environment, or
  4. Submission to, or rejection of, the conduct by the individual is used as the basis for any decision affecting the individual regarding benefits and services, honors, programs, or activities available at or through the educational institution.
